GENERAL TERMS AND CONDITIONS OF SALE

ARTICLE 1 – APPLICATION OF THE GENERAL TERMS AND CONDITIONS OF SALE These general terms and conditions of sale apply to all orders placed on the good-laser.eu website. The good-laser.eu website is published by the company CREADIL SAS. The Seller is defined below as CREADIL, SAS with a share capital of 200,000 euros, whose registered office is located at 410 Rue le Chatelier 38090 VAULX MILIEU, registered with the Vienne Trade and Companies Register (R.C.S. Vienne 851 692 657). The Customer is understood as the one with whom the purchase-sale relationship is established and who is invoiced for the order. Any order placed on the good-laser.eu Site implies knowledge of these General Terms and Conditions of Sale as well as the Customer’s agreement to their entirety. CREADIL reserves the right to adapt or modify these general terms and conditions of sale at any time. In this case, only the General Terms and Conditions of Sale in force at the time of ordering shall apply.

ARTICLE 2 – ORDERS 2.1 Orders can only be placed on the good-laser.eu website.

2.2 French is the sole language offered for the conclusion of the sales contract.

2.3 Product availability is displayed on the good-laser.eu website.

2.4 Any quote offered to the customer by CREADIL will remain valid for one month from the date of issue.

2.5 Product characteristics are indicated on each product page. The photographs and descriptive elements of the products do not form part of the contract; if these elements contain errors, CREADIL cannot be held responsible. Manufacturers may change product specifications without notice. CREADIL may update and modify product specifications at any time and withdraw products from sale.

2.6 In case of unavailability of a product, CREADIL will contact the Customer as soon as possible. The Customer will then be informed of the product’s availability timeline. If the Customer does not wish to wait or if the product is permanently unavailable and the order has been paid for, CREADIL undertakes to refund the Customer within 30 days from the payment date.

2.7 Any order placed on good-laser.eu may generate the creation of a Customer Account. Access to the Customer Account is via the username and password provided by CREADIL to the customer. CREADIL cannot be held responsible for any actions carried out via or on your Customer Account by a third party to whom you have provided your credentials or who has gained access to your credentials or Customer Account.

2.8 To place an order on good-laser.eu, the Customer follows various ordering steps. These include selecting the product(s) via the specific product page, adjusting the quantity of products if necessary, customer identification via the “order” section, creating a Customer Account if necessary, accepting the order summary, accepting the General Terms and Conditions of Sale, accepting payment terms, and finalizing the order.

2.9 Checking the box to acknowledge and accept the General Terms and Conditions of Sale and clicking the “ORDER” button validate the order. These actions constitute an “electronic signature” equivalent to a handwritten signature. They constitute an irrevocable and unconditional acceptance of the order and the General Terms and Conditions of Sale by the Customer. The data recorded by the good-laser.eu Site constitute proof of all transactions between CREADIL and its Customers and will be kept for 5 years to enable the application of warranty services.

2.10 The Customer’s order number is provided for reference only and does not constitute an invoice number. The invoice is sent to the customer upon delivery of the order. It is strongly recommended that the Customer retains this invoice.

2.11 Any order placed on good-laser.eu may be automatically canceled if payment is not received. This cancellation period is extended to 5 working days for bank transfer payments and 10 days for check payments. CREADIL reserves the right not to validate your order for any legitimate reason, particularly if it does not comply with these General Terms and Conditions of Sale or if several serious and consistent elements raise suspicion of fraud.

2.12 Except for the application of Article 6, the customer may cancel their order as long as it has not been transmitted to the logistics department. The transmission to the logistics department corresponds to the email notifying that the order has been shipped. Once the order is prepared, cancellation can only be done by refusing the package upon delivery. For professionals, no unilateral cancellation of orders will be accepted without prior approval from CREADIL.

2.13 The information provided by the Customer when placing the order (including name and delivery address) is binding. CREADIL cannot be held liable in the event of an error causing delay or non-delivery.

2.14 The Customer may place an order for a product not yet available for delivery, which is indicated on the product page as “Available on order.” The Customer pays the sales price and will be delivered from the date indicated on the product page. The product is reserved in the Customer’s name during the waiting period for delivery.

ARTICLE 3 – PRICES

3.1 All prices of products and services offered for sale on the good-laser.eu website are expressed in euros, excluding VAT or including VAT, excluding shipping costs. They are subject to change in the event of a VAT rate modification.

3.2 CREADIL reserves the right to modify its prices at any time but undertakes to apply the rates in force at the time of order registration, subject to product availability at that date.

3.3 Ordered products remain the property of CREADIL until full payment is received. However, upon receipt of the order by the Customer or their representative, the risks of delivered goods are transferred to the customer.

3.4 Shipping costs are automatically calculated based on each order and are indicated on the order summary before final confirmation.

ARTICLE 4 – DELIVERY AND TRANSPORT 4.1 Delivery is made either by direct handover to the Customer or by making the order available (transport company or Pick-up Point).

4.2 Delivery times for the good-laser.eu website within the European Union are 4 to 5 working days. CREADIL reserves the right to cancel any order with a delivery address outside Metropolitan France if it considers the delivery costs inappropriate for the destination.

4.3 Delivery is made to the address provided by the Customer when placing the order. CREADIL undertakes to deliver within the specified timeframes, starting the day after payment is received (unless otherwise stated on the product page).

4.4 If the indicated deadline is exceeded by more than 7 days, except in cases of force majeure, the Customer may cancel the order and receive a refund.

4.5 If an order is not claimed within the given period, it will be returned to CREADIL at the Customer’s expense.

4.6 CREADIL cannot be held responsible for delivery delays due to force majeure or issues attributable to the Customer.

4.7 CREADIL reserves the right to choose the carrier

ARTICLE 5 – CONFORMITY

5.1 The Client is required to check the conformity of the delivered goods before signing any delivery document. In case of any anomaly, the Client must indicate their reservations, followed by their signature, directly on the delivery document. In the event of a serious anomaly (damaged or open packaging, missing or damaged products, etc.), the Client must refuse the package and specify the reasons for refusal on the delivery document. This verification is considered completed once the Client, or any authorized person receiving the package on their behalf, has signed the delivery document.

5.2 If no reservations are made at the time of delivery, and the Client later discovers that the goods are damaged, they must notify CREADIL via registered mail with acknowledgment of receipt within 3 business days following receipt of the order. Any claims made after this period will not be accepted, in accordance with the general terms and conditions of the carriers.

5.3 CREADIL undertakes to refund or exchange products that do not conform to the Client’s order. The Client must submit their request in writing via the contact form on the good-laser.eu website or by registered mail with acknowledgment of receipt to CREADIL within 15 days from the delivery date. The claim regarding product non-conformity must include the Client’s choice between a refund or an exchange. Any claims made after this period will not be accepted. Any exchange request by the Client must follow the procedure defined in Article 6.

5.4 In the cases referred to in this Article 5, product returns will only be accepted if the products are returned complete and in their original condition (original packaging, instructions, accessories, etc.). In such cases, the return shipping costs will be reimbursed by CREADIL.

ARTICLE 6a – RIGHT OF WITHDRAWAL

6a.1 The Client has a legal right of withdrawal period of 14 days from the receipt of their order to return any item that does not suit them. To initiate the return process, the Client must contact CREADIL customer service via the contact form or directly by phone. As provided by law, the right of withdrawal only applies to consumables that have not been unpacked and to equipment that has not been used and is in perfect condition in its original packaging.

6a.2 To optimize return conditions, the return must be pre-approved by our Customer Service, which will provide a return authorization to the Client. Approval may be denied if withdrawal conditions are not met. The return will only be accepted if the product is in perfect condition, meaning it is in its original, unopened packaging (except for equipment) and undamaged. Items returned by the Client that have been opened (except for equipment), damaged, or are in poor condition will be refused under the right of withdrawal. Return costs remain the Client’s responsibility. Shipping costs are non-refundable if the order exceeds €200, as CREADIL offers free shipping for orders over €200. For orders below €200, CREADIL will refund the Client at the rate of standard (non-express) shipping. As a general rule, goods travel at the Client’s risk. CREADIL recommends that the Client obtain appropriate insurance and take all necessary precautions to protect the product. The Client’s refund will be processed via bank transfer to the account used for the purchase within a maximum of 14 days following CREADIL’s receipt of the returned product.

6a.3 In accordance with applicable regulations, CREADIL will not accept the return of consumables once they have been unsealed by the Client.

ARTICLE 7 – PAYMENT

7.1 Orders are payable in full on the day of ordering via credit card (CB, Mastercard, VISA) and PayPal. The entry of banking information is done on a secure server to ensure the security and confidentiality of the information provided during the transaction.

7.2 Payment via bank transfer is available and must be received by CREADIL within 5 days after the Client’s order validation, or within 10 days for check payments. If payment is not received within this period, CREADIL reserves the right to cancel the order.

7.3 The order will only be considered accepted by CREADIL once the relevant banking payment centers have approved the transaction and CREADIL has validated the order based on its risk acceptance criteria.

7.4 To prevent fraud, CREADIL reserves the right to request proof of identity and address from the Client to approve the sale. The order processing will commence upon receipt of these documents. CREADIL reserves the right to cancel the order in the absence of required documents or if they are deemed non-compliant.

ARTICLE 8 – WARRANTY

8.1 Legal Warranties

8.1.1 Products sold on the good-laser.eu website benefit from the application of the legal warranty against hidden defects under Articles 1641 and following of the Civil Code and the legal warranty of conformity under Article L. 217-4 and following of the Consumer Code.

The Client may exercise these warranties by sending their request to: SAS CREADIL, 410 Rue le Chatelier 38090 VAULX MILIEU, or via the contact form on the website, or by phone at 09 77 92 15 08.

When the Client (non-professional) invokes the legal warranty of conformity, they:

  • Have two years from the delivery date to act;
  • May choose between repair or replacement of the product, subject to cost conditions outlined in Article L. 217-9 of the Consumer Code;
  • Are exempt from proving the defect existed within 24 months following the delivery of the product, except for second-hand goods where the period is 6 months.

The conformity warranty applies independently of any commercial warranty granted.

The Client may also implement the warranty against hidden defects under Article 1641 of the Civil Code and, in such a case, may choose between contract rescission or a reduction in the sale price in accordance with Article 1644 of the Civil Code.

8.1.2 For professional Clients, the above warranties are reduced to one year from the product delivery date, except for wear parts as defined non-exhaustively in Article 8.9.
